Terms and conditions of the Carolina One Vacation Rentals - Kapp Lyons Group Agreement may not be transferred or assigned. This Agreement shall be interpreted and enforced according to the laws of the State of South Carolina. The invalidity or unenforceability of anyone or more provisions of this Agreement shall in no way effect any other provisions.
Each property is privately owned with Carolina One Vacation Rentals acting solely as AGENT for the OWNER. The GUEST acknowledges he is a licensee of the OWNER and not a tenant, and is not acquiring any interest in the property. Properties reflect the owner's personal style in furnishings and decor.
Guest agrees to indemnify and hold harmless the Owner and Managing Agent from any liability for damages to person or property of Guest, its invitees, agents, and licensees.
CHECK-IN is no earlier than 4:00 PM and the CHECK OUT time is no later than 10:00 AM. If guests enter the property prior to the 4:00pm check-in time, or guest’s departure is later than 10:00AM, penalties will be assessed. There will be no refund for early departures for any reason, weather-related, or otherwise. Upon departure, guests are asked to load and start the dishwasher and replace all furnishings to their original location.
If arriving after 5:00PM, the rent must let the Company know in advance so that arrangements can be made about the keys. Advance payment in full is required for late arrival.
Advance Rental Payments (one-half of the rental rate, $50 non-refundable reservation fee, travel insurance & security deposit waiver, if accepted) are due within 7 days of making reservations. FINAL RENTAL PAYMENTS ARE DUE SIXTY (60) DAYS PRIOR TO CHECK-IN. Personal checks will only be accepted if received at least 60 days in advance of check-in date. ALL RESERVATIONS NOT PAID IN FULL SIXTY (60) DAYS IN ADVANCE OF THE CHECK-IN DATE WILL INVOKE THE CANCELLATION POLICY. In the case of reservations made less than 60 days in advance, payment must be made by certified check, money order, credit care or traveler’s checks. No personal checks accepted at check-in. By signing below, I the renter, hereby authorize Carolina One Vacation Rentals / Kapp Lyons Group (the “Company”) to charge a valid credit card on file with the Company for any balance due if a balance is left on my account on the day of check-in, regardless of the manner in which I have furnished the Company information regarding that credit card
The security deposit will be processed within thirty (30) days after your check-out date.
Cancellations must be made in writing by the person in whose name the reservation is made. Advance rental payments, reservation fee and travel insurance are non-refundable. However, if the property is re-rented for the entire period of the reservations, the advance rental payments less a $100 cancellation fee and trip insurance will be refunded or transferred to another property. Cancellations made within 60 days of arrival will not receive any refund unless unit is re-rented as described above. If a cancelled reservation has not re-rented within 60 days of the scheduled arrival, Carolina One Vacation Rentals / Kapp Lyons Group reserved the right to discount the rental rate in order to secure a rental. If it rents at a discounted rate, the difference in the rates will be deducted from any refund paid. A $20.00 processing fee will be charged for changing dates within the same unit.
It is strongly recommended that you purchase travel insurance to protect against unforeseen occurrences that may result in loss of rental. Travel insurance protects you from losses you may incur because of unforeseen circumstances, such as illness, injuries, or Acts of God such as mandatory hurricane evacuations, and the like. We recommend that you purchase this travel insurance. Please contact the property management office for further information.
NO REFUNDS WILL BE GIVE FOR VOLUNTARY OR MANDATORY HURRICANE EVACUATIONS, inclement weather, or other conditions beyond the control of the Company.
ABSOLUTELY NO PETS inside or outside of unit unless otherwise noted. Any guest who is found to have a pet on the premises of a non-pet house will be required to vacate the rental unit immediately without any refund of rent or security deposit. Undeclared pets in house will result in forfeiture of any security deposit, if taken or the pet fee will be charged if the security deposit waiver was taken.
Linens and towels are not furnished. Pillows and bedspreads are furnished. Rental linens are available at an additional charge. Please reserve prior to arrival. If linens have been rented, all would need to be stripped and linens returned to the office upon departure. Otherwise, bedspreads are to be put back on beds upon departure.
Starter Amenity Kit provided consists of 1 trash bag in every trash can and kitchen hand towels.
Properties are all privately owned and that the management company reserves the right to refuse service to anyone. Guests are responsible for any damages caused by my party’s carelessness or negligence, including but not limited to accidents or injury of any kind to guest, loss of money, jewelry or values of any kind. Guests must leave the rental unit clean and in good order. It is the guest responsibility to report all previous damage within hours of check-in or they could be held responsible. Guests agree to submit a SECURITY DEPOSIT WAIVER of $50 per week which will cover accidental damage up to $1,000 or a SECURITY DEPOSIT, and guests agree to replace or pay for any loss, breakage, damage, furniture rearrangement, unnecessary service calls or extraordinary cleaning, even if the costs and/or expense exceed the amount of the security deposit.
All guests will receive a copy of the Security Deposit Waiver Plan and understand that it does/does not cover according to the plan and that they are completely responsible for all such damage caused by any occupants or the guests of any occupants. Not reporting all damage prior to departure voids the Security Deposit Waiver. THE COMPANY HAS AND IS HEREBY GRANTED FULL AUTHORITY TO COLLECT FOR DAMAGES FROM THE CREDIT CARD ON FILE WITH THE COMPANY, AND THE COMPANY’S DETERMINATION OF CHARGES WILL BE CONCLUSIVE AND FINAL. Please contact Carolina One Vacation Rentals - Kapp Lyons for the remaining portion of this policy.
Carolina One Vacation Rentals - Kapp Lyons Group cannot be, and will not be, responsible for homes that may be under construction next to or near the home I rent. New construction may also alter the views from homes. I realized that is a matter beyond the control of the Company and that refunds or substitutions cannot be made.
MAXIMUM NUMBER OF PEOPLE that may occupy unit is the number listed on the deposit request and rental agreement contract. Overloading will result in the immediate termination of occupancy without refund of any kind, and the Property Management Company is authorized to remove the occupants and their belongings from the unit without necessity of any judicial process. The renter agrees that may occupant refusing to vac ate the unit/property for any reason when told to vaccate the unit/property by the Company shall be deemed to be a trespasser after notice.
NO HOUSE PARTIES are allowed under any circumstances. Should a house party occupy this unit, occupancy will be terminated immediately with no refund. The determination as to whether there is a house part occupying a rental unit will be at the sole discretion of the Company. A house party may be but is not limited to: any group made up of persons unit the age of 25 who are not members of the same family or any group of people staying overnight at the property in excel of MAXIMUM NUMBER OF PEOPLE as listed on the deposit request and rental agreement contract. Any questions as to the allowed number of occupants for a particular unit should be addressed to the Property Management Company prior to signing the renal agreement. We STRICTLY adhere to our policy of renting to adult and family groups only. If the renter is not sure about the rent’s group, the renter should call the Company prior to signing the rental agreement. Any wedding or unction must be approved in writing at the time of the reservation by the homeowner and the management company.
The Property Management Company reserves the right to substitute comparable accommodation if circumstances require it in the Company’s sole discretion.
Absolutely no smoking is allowed inside the property. A valid credit card must be presented by the renter at check-in. This card will be recorded, and the Property Management Company is hereby authorized by me, the undersigned renter, to charge on the card for any extra cleaning of the unit determine to be necessary by the Property Management Company, in its sole discretion, on account of any smoking the Company determines, in its sole discretion, has occurred inside our non-smoking unit.
If the home is not left in good order, as requested, a charge for the extra cleaning expense will be assessed against the renter.
All phone calls, except on Edisto Island and Emergency 911 calls are long distance. THE RENTER IS RESPONSIBLE FOR ALL LONG-DISTANCE CALLS MADE. The renter should either reverse charges or charge calls to a credit card. If the Company bills the renter for any long-distance calls, there will be an additional $30.00 billing fee.
Carolina One Vacation Rentals is not responsible for air conditioning or any other appliance that fails to operate properly or for other maintenance issues including, but not limited to, pest control and housekeeping and no refunds will be given. The guest agrees to notify their appropriate Carolina One Vacation Rentals office as soon as a maintenance problem occurs. Breakdowns and other maintenance issues will be repaired or replaced as quickly as possible.
All properties are cleaned prior to guest check-in with fresh linens and towels. Guests pay a departure cleaning fee, which is included in their overall rental price. If excessive cleaning is deemed necessary by Carolina One Vacation Rentals, or check out instructions are not followed, the credit card on file for the guest's reservation will be charged appropriately.
The guest agrees that Carolina One Vacation Rentals and/or contractors or employees may enter the premises when the property management company deems it necessary. Guests are to call 911 in the case of a medical or fire emergency. On call staff is available 24/7 for maintenance emergencies, such as issues with water, sewer, or gas. Issues such as internet outages, appliance malfunctions, etc. will be handled during business hours the next day.
Carolina One Vacation Rentals is not responsible for any personal belongings of the guest that may become lost, stolen, damaged, or left behind. If found, the items will be returned to the guest at the guest's expense. If the items are left unclaimed with Carolina One Vacation Rentals over 30 days, the items will be donated to a local charity.
Rates are subject to change until a reservation has been paid for and confirmed. Errors in pricing and descriptions rarely occur and the guest will be notified in any event of error. If in the opinion of Carolina One Vacation Rentals, the error substantially changes the terms of this Agreement, the guest may cancel the reservation within five business days after receiving such notification and the guest will receive a full refund. We reserve the right to make corrections, additions, deletions, and changes in the rates and descriptions at any time without notice. Should the accommodation become unavailable due to reasons beyond control, Carolina One Vacation Rentals will do their best to provide alternative accommodations and will notify the guest of the alternate property options available. Should the guest deem the alternate properties unacceptable, a full refund of the deposits paid will be returned to the guest. Taxes and fees may not be included in quoted rates.
Tax rates are calculated and added to the reservation according to the state sales tax, state and local accommodation taxes and fees, and local laws enforced at the time of this agreement. Such taxes and fees are subject to change without notice. Guest is responsible for any increase in tax which may occur prior to arrival.
We want to protect & respect our wildlife! The guest agrees to comply with all city regulations in regards to the protection of sea turtles. Sea Turtles are an endangered species. Do not interfere with them in any way. No lights are allowed that illuminate the front beach between 10:00 PM and dawn from May 1st to October 31st. Hatchling turtles are disorientated by artificial light. Fill in all holes dug in the sand before you leave the beach. Any fines issued by the Town of Edisto Beach as a result of non-compliance by the guest will be charged to the guest's credit card on file.
